The use of our services, as well as the purchase of our products, will imply that you have read and accepted the Terms and Conditions of Use in this document. All products offered by our website may be created, charged, shipped, or presented by a third-party website and, in such a case, would be subject to their own Terms and Conditions.
All purchases and transactions carried out through this website are subject to a confirmation and verification process, which may include verification of product stock and availability, validation of the payment method, validation of the invoice and compliance with the conditions required by the selected payment method. In some cases an email verification may be required.
The prices of the products offered in this Online Store are valid only for purchases made on this website.
LICENSE
GARDINITY, S.L., through its website, grants users a license to use the products sold on this website in accordance with the Terms and Conditions described herein.
PROPERTY
You may not claim intellectual or exclusive ownership of any of our products, modified or unmodified. All products are the property of the content providers. In no event shall this company be liable for any damages, including, but not limited to, direct, indirect, special, incidental, or consequential damages or other losses resulting from the use or inability to use our products.
ANTI-FRAUD CHECK
The customer’s purchase may be postponed for anti-fraud verification. It may also be suspended for a longer period for a more rigorous investigation to prevent fraudulent transactions.
PRIVACY
The user accepts that all their personal data will be fully transferred to SEQURA from the moment the user has initiated the contracting of the deferred payment service offered by the latter when choosing the payment method. This acceptance extends to third-party entities that may need to access the files for the proper fulfillment of the contract.
Jardinartificial.es guarantees that the personal information you submit has the necessary security. The data entered by the user or, in the case of requiring order validation, will not be delivered to third parties, unless it must be disclosed in compliance with a court order or legal requirements.
GARDINITY, S.L. reserves the right to change or modify these terms without prior notice.
PRODUCTS
Artificial turf models and accessories may vary in texture, composition, color, dimensions and shape for different games or seasons.
SHIPPING
The delivery time for orders is between 5 to 7 business days on the peninsula. Shipping to the Balearic Islands, Canary Islands, and Portugal is 5 to 10 business days. This period may be extended due to reasons beyond Artificial Garden’s control. In any case, we will always contact the customer to find a solution.
If you request the shipping agency to postpone the delivery date of your order, an additional storage cost of €15 per day and per package may be incurred, which must be borne by the customer.
Shipping costs for orders to mainland Spain are €9.95 (VAT incl.) for orders under €200 (VAT incl.). The price to all Balearic Islands is €75 (VAT Incl.), while for the Canary Islands, Ceuta, and Melilla it is €120 (VAT Incl.), regardless of the order amount. Shipments to Portugal have a fixed price of €75 (VAT Incl.). Transportation is up to street level.
For sample shipments, the first one will be free to all peninsular Spain, the following ones will have a cost of 5,95€. For shipments to Ceuta, Melilla and the Balearic Islands, a cost of 15€ applies. We do not ship to the Canary Islands. Shipments to Portugal have a cost of 15€.
INCIDENTS, RETURNS AND REFUNDS
The consumer and user must report the lack of nonconformity within two days of becoming aware of it.
If the goods arrive in poor condition, it is mandatory that the consumer signed the delivery note of the carrier indicating the problem found and notify Artificial Garden within a maximum period of 24 hours. We can not accept claims that do not appear on the delivery note the breakage or damage to the material.
The consumer has the right of withdrawal within 14 calendar days from receipt of the product. The consumer will be responsible for the return postage, (60 € + VAT) on the other hand the product must be returned with its original packaging and in perfect condition, otherwise the product could suffer a devaluation.
It will not be possible to claim incidents derived from transport or product returns if the product has been handled or installed.
Requests for return of goods and communication of incidents arising from transport or any other kind, should be made by mail to the address incidencias@jardinartificial.es, which must be indicated in the subject, your order number and type of incident.
Orders placed with the cutting and handling add-on are non-returnable.
Once the goods have been received and found to be defective or wrong, we will proceed to the economic return or replacement of the defective item(s).
(The minimum purchase age must be 18 years old).
