PURPOSE
This document governs the conditions of access, navigation, and use of the website, as well as the purchase of artificial grass and accessories offered by the company.
PURCHASE CONDITIONS
It is a necessary requirement for the purchase of products offered on this site that the customer reads and accepts the following Terms and Conditions set forth below.
The customer declares that they are of legal age and have legal capacity to contract.
The use of our services, as well as the purchase of our products, will imply that you have read and accepted the Terms and Conditions of Use in this document.
All products offered on our website may be created, charged, shipped, or presented by a third-party website and in such cases would be subject to their own Terms and Conditions.
All purchases and transactions carried out through this website are subject to a confirmation and verification process, which could include stock and product availability verification, payment method validation, invoice validation, and compliance with the conditions required by the selected payment method. In some cases, verification via email may be required.
The prices of the products offered in this Online Store are valid only for purchases made on this website.
LICENSE
GARDINITY, S.L., through its website, grants a license for users to use the products sold on this website in accordance with the Terms and Conditions described in this document.
OWNERSHIP
All website content is owned by content providers or is licensed for use. Consequently, you may not claim intellectual or exclusive ownership of any of our products, modified or unmodified.
ANTI-FRAUD CHECK
The company reserves the right to postpone order processing in order to carry out appropriate fraud prevention checks. Likewise, it may temporarily suspend the purchase process for a longer period when additional checks are necessary, all with the aim of ensuring transaction security and preventing fraudulent operations.
PRIVACY
The user accepts that all their personal data will be fully transferred to SEQURA from the moment the user has initiated the contracting of the deferred payment service offered by the latter when choosing the payment method. This acceptance extends to third-party entities that may need to access the files for the proper fulfillment of the contract.
Jardinartificial.es guarantees that the personal information you submit has the necessary security. Data entered by the user, or obtained in cases requiring order validation, will not be shared with third parties unless it must be disclosed in compliance with a court order or legal requirements.
GARDINITY, S.L. reserves the right to change or modify these terms without prior notice.
PRODUCTS
Artificial grass models and accessories may vary in texture, composition, color, dimensions, and shape if they come from different batches or seasons.
PURCHASE PROCESS
The customer must select the desired products, add them to the cart, and complete the purchase process by providing the required information.
Before completing the purchase, a summary of the order will be displayed with the total price, including taxes and shipping costs.
PRICES AND PAYMENT METHODS
All prices are expressed in euros and include applicable taxes.
The payment methods indicated on the website are accepted.
SHIPPING AND DELIVERY
Orders will be shipped to the address indicated by the customer within the following timeframes:
- 5 to 7 business days in mainland Spain
- 5 to 10 business days to the Balearic Islands, Canary Islands, and Portugal.
This timeframe may be extended due to circumstances beyond the control of Jardín Artificial. In any case, we will always contact the customer to find a solution.
In the event of requesting the transport agency to postpone the delivery date of the order, an additional storage cost of €15 per day and package may be generated, which must be assumed by the customer.
Should access to the delivery location present conditions that hinder or limit the usual circulation of delivery vehicles, such as unpaved roads, difficult-to-pass routes, or any other circumstance preventing delivery under normal conditions, any additional costs arising from such a situation will be borne by the customer.
Shipping costs:
- To mainland Spain: €9.95 (VAT incl.) for orders under €200 (VAT incl.).
- To the Balearic Islands: €75.00 (VAT incl.); and to the Canary Islands, Ceuta, and Melilla: €120.00 (VAT incl.), regardless of the order amount.
- To Portugal: €75.00 (VAT incl.).
- Sample shipments:
- To all of mainland Spain: The first will cost €8.20 + VAT.
- To Ceuta, Melilla, and the Balearic Islands: Cost of €15.00
- To Portugal: cost of €15.00.
- We do not ship to the Canary Islands.
In the event that the delivery address provided by the customer is incorrect, incomplete, or contains errors that prevent the delivery of the order, any costs arising from the modification of the address, re-routing, return, or re-shipment shall be borne by the customer.
Transportation is up to street level.
INCIDENTS, RETURNS, AND REFUNDS
The customer has a period of two days to report any disagreement with the delivery.
In the event that the goods arrive in poor condition, the consumer must sign the carrier’s delivery note indicating the problem found and notify Jardín Artificial within a maximum period of 24 hours. The company is not responsible for any claim in which the description of the breakage or defect of the material is not stated on the delivery note.
The consumer has the right to withdraw from the contract within 14 calendar days from receipt of the order, with return shipping costs (€60.00 + VAT) borne by the consumer. In this case, the product must be returned with its original packaging and in perfect condition, since otherwise the product could suffer a devaluation.
It will not be possible to claim incidents resulting from transport or product returns if the product has been handled or installed.
Requests for merchandise returns and the communication of incidents resulting from transport or of any other nature must be made by sending an email to incidencias@jardinartificial.es, indicating the order number and type of incident in the subject line.
Orders placed with the addition of cutting and handling will not be eligible for returns.
Once the merchandise has been received and verified as defective or incorrect, we will proceed with a refund or replacement of the defective item or items.
PRODUCT REVIEWS
The customer grants their free, specific, informed, and unequivocal consent to receive electronic communications intended to obtain their review of purchased products.
Such communications will be strictly linked to the contractual relationship maintained, and their purpose will be to improve service quality and user experience, as well as to generate informative content for other customers.
By checking the corresponding box during the purchase process, the customer consents to:
- Receive automated emails requesting their opinion or review of purchased products.
- That such communications be sent based on their purchase history.
This consent is independent of consent for commercial communications and may be revoked at any time, easily and free of charge, through the link provided in each communication or by request addressed to the data controller.
The customer may leave reviews on purchased products. These reviews must be truthful and must not contain unlawful, offensive, or misleading content.
The company reserves the right to moderate or remove reviews that violate these conditions.
LIABILITY
The company will not assume any liability for any damages or losses, including, by way of example and not limitation, direct, indirect, special, incidental, or consequential damages, as well as any other losses that may arise from the use, or inability to use, the products sold.
APPLICABLE LAW
These conditions are governed by Spanish law.
For the resolution of disputes, the parties submit to the courts and tribunals of the consumer’s domicile.
